Consent for Commons
A collaborative space to capture consent in the context of Creative Commons and open license around the world.
1. What kind of scenarios do you or others you know use "consent" related to Creative Commons or copyright? 👥
recording videos, audios
physically touching anyone
taking a photo of someone
publishing a photo of someone
Touching - yoga, trainer, doctor
when we collect private data
Giving a hug to a child
I may have just gave permision to use the data that I'm writing in this form to mozilla, somehow connected to my Gmail identity. But I don't really know what consent I've given.
I have worked in documentary film for a few decades. Over this time, notions of consent have changed dramatically. The most important point I would like to make is that notions of consent change as technology changes. So, for example, if I filmed someone in 1995, we couldn't imagine that the film might end up streaming on the internet, or that information could be gathered by AI. The consent that is given should always be connected not to the technology used (I'm taking a picture, or shooting video) but to the potential use (I am taking a photo to be uploaded to a platform) Also, in the case of the person who doesn't want their legal name associated with their image, this could become problematic in cases where facial recognition technology is used.
2. Assumptions you or others make [ Considerations: gender, ethnic/cultural, social ] 💬
I would assume that I have to ask for permission to record an ongoing religious activity (prayers at mosques, church services), out of sensitivity and respect to the community
I like to assume that people can decide if they do or do not want to be recorded. I like to allow people to ask questions.
if you are on a dance floor
if you in a party -greeting
assumptions made based on where community is based
If you part of a theatre - again body contact and language
If you in sports - body contact is assumed
3. How is the distribution of your community -- at work and in you volunteer world? 👷♀️🧕👨🎤👨💻
Cultural, economic
Not everyone in the community has access to internet / hardware
professors are male and teachers are women
profession diversity
gender diversity
4. What should we include if we build a consent library for Creative Commons practitioners? ✎✐
Examples of permission/personal release forms from around the world, examples of bad situations where consent was given, but participants may not have understood the impact of their consent. Be responsible!
Wahtever - should be culturally sensitive
